Terms & Conditions

General

  1. Upon acceptance of these terms, a binding contract is entered into between the customer and Shut It Solutions.
  2. Quotations provided by Shut It are valid for 14 days from date on Quote and may be subject to change after that time.
  1. Acceptance of a quotation occurs when the customer accepts the quotation in writing and/or pays the required deposit. No order will be placed into manufacture until the required deposit has been received unless otherwise agreed by Shut It Solutions in writing.
  2. Completion dates provided on our quotes/contracts are estimates only and are subject to material availability. Shut It shall not be liable for any failure or delay to supply, deliver or install the products where such failure or delay is wholly or partly due to any cause or circumstance whatsoever outside the reasonable control of Shut It.
  3. Customer to make access to the works available between 7.00am to 5.00pm Monday to Friday or as otherwise agreed.
  4. Whilst every attempt will be made by Shut It to ensure that the products sold and delivered match samples or products on display in showrooms or at in-house consultations, any minor or immaterial variation or change in colour or grain between the sample and the goods delivered shall not entitle the customer to reject the goods nor to claim any compensation for such variation or change.
  5. Shut It Solutions strives to achieve the highest standard possible in the manufacture and installation of products which have been purchased and all work will be carried out as directed by Shut It unless specific instructions are written on this agreement or actual written specifications are given to Shut It by the customer at point of sale.
  6. Customer acknowledges that Shut It staff are not qualified colour consultants or interior decorators – any suggestions or recommendations are their opinions only and the customer takes responsibility for the choice of materials or products ordered.
  7. Shut It Solutions reserves the right to rectify any errors made by Shut It or their Sub Contractors without compensation to the customer.

Conditions Of Quotation

  1. By placing of an order and accepting our quotation you are acknowledging and confirming that you accept and will comply with the full terms and conditions of Shut It Solutions.
  2. Orders will not be processed until confirmed receipt of deposit is received by Shut It Solutions.
  3. The customer is advised to check that the colour, finish, shutter/blind layout and fit, blade size and cord controls positioning that are set out on the quotation are correct.
  4. Any additional products not included in the original quotation will be treated as a separate order and invoiced accordingly. Payment of the final balance for the original order cannot be withheld or delayed while awaiting supply or installation of an additional order.
  5. All goods remain the property of Shut It Solutions until payment has been made in full. Ownership of the goods will not pass to the customer until full payment has been received.
  6. The information contained or referred to in the quotation documents is confidential and must not be disclosed or released for any other use or purpose.

Final Check Measure & Variations

All quotations are subject to final check measure and confirmation of site conditions, measurements, product specifications and installation requirements prior to manufacture.

Where the final check measure identifies differences in measurements, site conditions, structural or fixing requirements, product specifications, access requirements or other circumstances that affect the scope or cost of the works, Shut It Solutions reserves the right to revise the quotation accordingly.

The customer will be advised of any material variation to the price or scope of works before the affected products are placed into manufacture.

Payment Terms

  1. A 50% deposit is required to confirm the order and commence processing. Unless otherwise agreed in writing by Shut It Solutions, no products will be ordered or placed into manufacture until the required deposit has been received.
  2. The remaining balance is due in full immediately upon completion of installation. Where an order is supply-only, the remaining balance is due prior to collection or delivery of the goods.
  3. Where an order involves multiple products or installations completed in stages, Shut It Solutions may invoice for products and/or works as each stage is completed. Payment of each such invoice is due upon completion of that stage unless otherwise agreed in writing.
  4. Any variations, additional products, additional labour or works requested by the customer, or required due to site conditions or circumstances that could not reasonably have been identified at the time of quotation, may incur additional charges. Where practicable, the customer will be advised of these costs before the additional work is undertaken.
  5. The customer must not withhold or delay payment of an amount that is properly due because of a minor defect, adjustment, service item or outstanding work that does not prevent the substantial completion or reasonable use of the installed products. Shut It Solutions will attend to any legitimate outstanding items in accordance with its obligations, including any rights the customer may have under the Australian Consumer Law.
  6. Any amount not paid by the due date will be considered overdue. Shut It Solutions reserves the right to suspend any further supply, installation or service work until overdue amounts are paid.
  7. Where an overdue account is referred for debt recovery, the customer may be required to pay the reasonable costs incurred by Shut It Solutions in recovering the overdue amount, to the extent permitted by law.
  8. Payment may be made by EFT, credit card or other payment methods accepted by Shut It Solutions. Credit card surcharges may apply where disclosed and permitted by law.
  9. All prices and payments are in Australian dollars and inclusive of GST unless otherwise stated.

Product

  1. Customer accepts that any powdercoat colours and brand stated on this quote are as per the customer’s selection and that Shut It Solutions takes no responsibility for shade variations.
  2. Shut It Solutions accepts no responsibility for material variations such as colour, grain, rippling, shrinkage or changes in length and Shut It Solutions shall not be liable in any way for loss or damage suffered as a consequence thereof.
  3. The acceptable standard for imperfections on the final job is – if it is visible with the naked eye, in natural daylight at a distance of 1.2 metres, it is not acceptable. If it is not visible with the naked eye, in natural daylight, at a distance of 1.2 metres it is acceptable.
  4. Shut It Solutions accepts no responsibility for client’s windows, floors or building being out of square.
  5. Only goods and products itemised in this quotation will be supplied.
  6. Please be aware that as Veri Shades ® fabric is a woven fabric, there could be some variation in dye batches and fabric texture from the sample swatches and previous orders.

Installation

  1. Customers are required to provide suitable access for all installation inside and outside the house and to remove any obstructions which could interfere with such installation or valuables which could be damaged. If a Shut It technician encounters any unforeseen difficulty with access or installation of the products ordered, the customer agrees to pay for any additional costs that may arise.
  2. Customers are responsible for advising Shut It of the presence of any Asbestos at the installation address, that could be disturbed during the installation of the Shut It products.
  3. Shut It Solutions products are generally manufactured square unless specifically designed otherwise. The customer acknowledges that existing windows, openings, walls, floors, rooflines and other installation surfaces may not be square, straight, level or uniform.

    Shut It Solutions accepts no responsibility for gaps or variations in fit caused by existing site conditions, including but not limited to sloping, angled, uneven or out-of-square windows, walls, rooflines, floors or other surfaces.

    Plantation shutters may have visible gaps around the frame, particularly where existing window openings are not square or straight. Where appropriate, Shut It Solutions may use gap filler to assist in achieving a neat finish and reducing visible light gaps. The customer acknowledges that some gaps may remain due to the condition or construction of the existing opening.

  4. Shut It Solutions will exercise reasonable care when installing products. The customer acknowledges that installation may require drilling, screwing or fixing into existing surfaces and materials, including but not limited to tiles, Hebel, brickwork, masonry, plasterboard, blue board, timber, walls and architraves.

    Shut It Solutions will not be responsible for unavoidable or incidental damage arising from the condition, age, weakness, movement or failure of existing materials or surfaces, where reasonable care has been exercised during installation. Nothing in this clause excludes any rights or remedies that cannot lawfully be excluded under the Australian Consumer Law.

  5. Where a motorised product requires electrical work or connection by a licensed electrician, the customer is responsible for arranging and paying for this work at their own expense unless electrical work is expressly included in the quotation. This includes, but is not limited to, motorised outdoor blinds, Zipscreens, indoor blinds, awnings and hardwired roller shutters. Electrical work is not included in the quoted price unless specifically stated otherwise in writing.
  6. Corded Blinds – Please note that blinds installed by Shut It will comply with Australian Child Safety Laws for corded blinds.
  7. Plantation Shutter Gap Filling – Where appropriate, Shut It Solutions may use gap filler around L-Frame plantation shutters to achieve a neat finish and reduce visible light gaps. If the customer requests that gap filler not be used, the customer may be required to sign a waiver acknowledging responsibility for any resulting gaps and for completing any gap filling themselves after installation.
  8. Where an installation, check measure or service appointment cannot proceed due to the customer failing to provide agreed access, adequately prepare the installation area, or otherwise meet an agreed site requirement, Shut It Solutions reserves the right to charge a reasonable call-out or rescheduling fee to cover costs incurred.

Wind Sensor Disclaimer For Outdoor Blinds & Awnings

Wind sensors are an optional add-on designed to help protect awnings during windy conditions. They offer extra convenience but do not guarantee protection.

The customer understands that:

  • Wind sensors may not respond to all wind events or sudden weather changes.

  • The customer is still responsible for retracting awnings during bad weather, even if a wind sensor is installed.

  • Shut It Solutions is not liable for any wind or weather damage to awnings with or without a wind sensor fitted.

By proceeding, the customer accepts responsibility for operating the awnings safely in changing weather conditions.

Cancellation & Refund Policy

  1. All goods supplied by Shut It Solutions are manufactured to order and cannot be re-sold as each product is custom made.
  2. Requests to change or cancel an order must be made in writing to Shut It Solutions as soon as possible. Once an order, or any part of an order, has been placed into manufacture or materials have been ordered, changes or cancellation may not be possible and costs already incurred may be payable by the customer.You may phone and notify us of the cancellation but it must be confirmed in writing to email: info@shutitsolutions.com.au
  3. Cancellation of the order after order is placed into manufacture, will incur the cost of any material outlays from the manufacture. If the product has been manufactured the invoice will still be due in full.
  4. Shut It Solutions will make all attempts to action any requests for changes or cancellation without charge, however if costs have been incurred you may incur charges up to the maximum value of the original order.
  5. We have the right to cancel your order if:

-We have insufficient stock to make and deliver the goods ordered.

-The goods ordered unbeknown to us have been discontinued.

-A pricing error or typing error has occurred due to system failure within our database or website.

  1. If for any reason beyond our reasonable control, we are unable to supply a particular item, we will notify you as soon as possible. No discounts or compensation can be offered under these unforeseen circumstances.

Approvals & Permissions

It is the customer’s responsibility to obtain all necessary approvals, permissions and consents required for the supply and/or installation of the products prior to confirming an order. This includes, but is not limited to, approvals from body corporates, owners corporations, strata managers, building managers, landlords, property owners, councils or any other relevant authority or third party.

By accepting the quote and/or paying a deposit, the customer confirms that all necessary approvals have been obtained or, where the customer elects to proceed without obtaining such approval, that they do so entirely at their own responsibility and risk.

Shut It Solutions accepts no responsibility or liability for any costs, losses, delays, modifications, removal or reinstallation of products, penalties, disputes or other consequences arising from the customer’s failure to obtain the necessary approval or permission prior to proceeding.

Any costs associated with alterations, removal, reinstallation or other works required as a result of an approval not being obtained will be the responsibility of the customer.

Australian Consumer Law

Nothing in these Terms & Conditions is intended to exclude, restrict or modify any guarantee, right or remedy available to a customer under the Australian Consumer Law or any other applicable law that cannot lawfully be excluded, restricted or modified.

Where a right, guarantee or remedy cannot lawfully be excluded, these Terms & Conditions will apply subject to that right, guarantee or remedy.

Any voluntary warranty provided by Shut It Solutions or a manufacturer is subject to the applicable warranty terms and conditions. Nothing in these Terms & Conditions excludes or limits a customer’s rights under the Australian Consumer Law.

Any voluntary warranty provided by Shut It Solutions may be affected or voided where a product has been repaired, altered, modified or adjusted by an unauthorised person, to the extent that the unauthorised work caused or contributed to the fault or damage.

Shut It Solutions may update these Terms & Conditions from time to time. The Terms & Conditions applicable to an order are those provided to or accepted by the customer at the time the order is accepted, unless otherwise agreed in writing.
